The Port Harcourt Zonal Command of the Economic and Financial Crimes Commission (EFCC) achieved a significant milestone in its fight against cybercrime with the successful conviction and sentencing of an internet fraudster, Kpalap Dorka.
The conviction came following proceedings before Justice S.D. Pam of the Federal High Court sitting in Port Harcourt, Rivers State.
Dorka was found guilty of a one-count charge bordering on impersonation, as stipulated in Section 22(2)(b) of the Cybercrime (Prohibition, Prevention) Act 2015.
According to the charge, he fraudulently posed as Jane Williams, a white lady, on his Telegram account with the username @Bloomin and phone number +2348117200482, with the intent to deceive and gain an advantage for himself.
Upon pleading guilty to the charge, the prosecution counsel, Endeba Abbiyesuku, urged the court to convict and sentence the defendant accordingly.
Counsel to the defendant, Samuel Berkinbo, did not contest the prosecution's prayers but appealed for leniency, highlighting Dorka's status as a first-time offender with no prior criminal record.
Justice Pam, after considering the plea and arguments presented, sentenced Dorka to two years' imprisonment in the Nigeria Correctional Centre, with the option of a N1,000,000.00 (One Million Naira) fine.
Additionally, the Judge ordered the forfeiture of Dorka's iPhone 13 Pro Max and Lexus ES 350 to the Federal Government of Nigeria.
These assets will be sold through public auction, and the proceeds deposited into the EFCC Recovery Account with the Central Bank of Nigeria.
Dorka's arrest on March 11, 2024, followed actionable intelligence on his fraudulent activities and extravagant lifestyle.
Investigations revealed his modus operandi, wherein he masqueraded as an investor named Jane William to deceive victims into believing he was associated with a brokerage platform, thus defrauding them.
This conviction underscores the EFCC's commitment to combating cybercrime and bringing perpetrators to justice, while also serving as a warning to others engaged in similar illicit activities.
