The National Industrial Court, seated in Ibadan, has upheld Justice Adepele Ojo as the Chief Judge of Osun State, in a ruling delivered by Justice Peters on Wednesday under case file NICN/IB/62/2023.
The court granted all reliefs sought by Justice Ojo against the Osun State Government and the Osun State House of Assembly, solidifying her position as the state's top judicial officer.
A key aspect of the court's decision is the issuance of a perpetual injunction, restraining both the executive and legislative branches of Osun State from removing Justice Ojo from her role as Chief Judge. This ruling comes amidst a period of legal and political tension between Justice Ojo and the state authorities.
The conflict initially surfaced in 2023 when the Osun State Assembly moved to suspend Justice Ojo, leading to the contentious appointment of an acting Chief Judge, Justice Olayinka Afolabi, who ultimately did not assume the role as anticipated.
In response to the actions taken against her, Justice Ojo sought legal recourse by approaching the National Industrial Court in Ibadan. She successfully obtained a restraining order preventing Governor Ademola Adeleke from removing her from her position.
The situation has drawn considerable attention, eliciting criticism from various legal bodies and civil society organizations.
In defense of their actions, the Osun State Government spokesperson and Commissioner for Information and Public Enlightenment, Kolapo Alimi, clarified that Governor Adeleke had not dismissed Justice Ojo.
Instead, he had forwarded the legislative resolution and recommendation for an acting appointment to the Chief Justice if the Federation for further consideration.
