The Federal Capital Territory High Court in Maitama handed down a significant ruling on Monday, imposing a hefty N10 million fine on the Economic and Financial Crimes Commission (EFCC) and three other parties for their infringement on the fundamental rights of Mr. Michael Kundera.
In a lawsuit brought forth by Kundera to seek justice for the violation of his rights, Justice Peter Kekemeke delivered a scathing judgment, highlighting the unlawful actions of the respondents.
Kekemeke emphasized that Kundera's rights were blatantly violated when he was arrested and detained from May 15 to May 16, 2023, without being formally charged or granted bail.
The judge condemned the respondents' behavior, particularly noting the advanced age of 75 years of the victim, asserting that such treatment was unacceptable. .
The court's ruling declared the arrest and detention as unlawful, with Kundera's legal counsel, Dr. O. Orji, arguing passionately against the injustice faced by his client.
Orji underscored the pending legal proceedings and the clear breach of constitutional rights, seeking redress for the harm inflicted upon Kundera.
The court's decision serves as a significant step in upholding the rights of individuals and holding accountable those who disregard legal protocols.
