In a recent development, the Economic and Financial Crimes Commission (EFCC) has opted to withdraw its application at the Court of Appeal pertaining to the arrest of former Governor Yahaya Bello of Kogi State, who is currently a fugitive.
The decision to withdraw the application was disclosed in a court filing on Tuesday at the Court of Appeal in Abuja, submitted by J.S. Okutepa, SAN, and others on behalf of the Commission.
The EFCC cited the fact that the application had been rendered moot due to the recent ruling by Justice Jamil J. of the Kogi State High Court on April 17, 2024. According to the Commission, the subject matter of the appeal had already been adjudicated upon by the Kogi High Court.
Furthermore, the EFCC informed the court that the notice of appeal had been filed outside the stipulated timeframe, and as such, they requested that the appeal be dismissed on the grounds of being untimely and incompetent.
The EFCC's attempt to arrest the former Governor had previously met with resistance at his residence in Abuja. Consequently, the Commission declared him wanted after failing to apprehend him for allegations related to an N80 billion fraud case.
